Traffic Safety Council of Zimbabwe boss, Kurauone Sibanda has been exposed to have allegedly defrauded the Grain Marketing Board after he ‘purchased’ grain from the state entity in 2010 without paying, court papers reveal
Under case number 3507/10 heard by Justice Charles Hungwe, Sibanda with his company Top Harvest agreed to procure 2000 metric tonnes of maize at USD$ 310 per tonne and was supposed to settle to purchase amount within 14 days from the date of delivery.
But court documents allege that Sibanda and his Top Harvest failed to settle the amount due USD$ 222, 056.10 for 716.310 metric tonnes collected.
“During the period extending from 29th January 2010 to 13th February 2010, the first defendant (Top Harvest Investment) collected a total of 716.310 metric tonnes of maize valued at USD$ 222 056.10 from plaintiffs depots. In breach of their obligations, First and Second Defendant failed to pay plaintiff the sum of USD$ 222.056.10 or any part thereof despite demand,” read part of court documents.
The court papers suggest that Sibanda had put two of his vehicles, a white Freightliner diesel truck horse (Reg Number ABJ 5096) and another similar truck ABJ 5055 as surety in an event that he breached the contract.
The documents allege that GMB failed to recover the money and the said vehicles were not found when the state entity sought for them to recoup their funds.
Justice Hungwe gave GMB the right to attach the vehicles and force Sibanda to pay for the delivered maize.
